A Process Of Divorce
A legal separation occurs when a Court enters an order legally
separating a husband a a wife. The Court's order is temporary.
Typically, it includes orders regarding bank accounts, stocks, and the
family home. A temporary child support order is usually entered at the
same time. A legal separation is a preliminary action to divorce, but a divorce need not occur after a legal separation has been granted (both parties can agree to withdraw the petition for divorce).
A legal separation addresses marital property and who is in possession of the family home. It also will inform spouses that they may not move assets, hide assets or spend marital money (in addition to regular and normal expenses).
The marital assets are not protected, nor is either spouse protected from the other's spending or charging without a legal separation.
Legal Separation As An Action
In some instances, a man and a woman may way to obtain a
legal separation, but not apply for a divorce. This type of legal separation
is the same as if they had applied for divorce in that it provides an
order defining who has the legal right to marital property (who can keep
possession of the family home, cars, bank accounts, etc.), but the application
to dissolve their marriage is not made.
