Divorce

  • Legal Separation: a first step in the divorce process or a separate legal action.
  • Collaborative Divorce Law: a relatively newer form of divorce focused on a mediation style in which both parties have their own attorney and both agree to resolve the issues (not go to court) with the assistance of financial and legal counselors.
  • Contested Divorce: from a court's view, all divorces are contested matters initially; contested divorce usually means litigated divorces in which the parties have disputes over children, property (including money), or support.
  • Divorce effects insurance, social security benefits, and deferred income plans including Wisconsin Retirement System accounts are affected by divorce.
  • Marital property includes property acquired during (and sometimes before) the marriage. A marital property settlement or agreement must be formed for all divorces.
